Terms of Service

1. Agreement

By using marblesend.com, activating a MarbleSend license or buying from us, you agree to these Terms. If you use MarbleSend for a company or a client, you confirm you may accept them on its behalf. Our Privacy Policy and Refund Policy are part of this agreement.

2. The software

MarbleSend is self-hosted email marketing software. You install it on hosting you control, and you are responsible for that hosting, your SMTP or email-sending provider, DNS records, backups and the security of your installation.

You are solely responsible for your subscribers, your email content and for complying with the laws that apply to your emailing, including consent, unsubscribe and anti-spam rules. Deliverability depends on your provider, DNS and sending reputation; we do not guarantee that any message is delivered or opened.

3. License

Subject to these Terms, we grant you a non-exclusive, non-transferable license to install and use MarbleSend, for an unlimited number of contacts, on the domains covered by your license:

• Regular License: one domain (a single site or client).
• Extended License: multiple domains, for agency, client or reseller use.

You may not resell, sublicense, publish or share your Purchase Code, your License Key or the software, and you may not remove or bypass license activation or verification. The source code is human-readable so you can inspect it; that does not transfer ownership or allow redistribution.

4. Activation and verification

The software is activated with a Purchase Code (Envato) or a License Key (direct purchase) and is bound to your domain. It contacts our License Server to activate, to re-check the license about once a week and to check for updates. If the License Server cannot be reached, the installation keeps working for a grace period.

If a license is revoked, refunded or lapsed, features that create new campaigns, schedules or autoresponders may be restricted. We never delete the data on your server.

5. Updates, support and early versions

Versions you have purchased remain usable. The Regular and Extra Domain licenses include 1 year of version updates and support, and the Extended License includes 2 years; these Terms do not promise a particular response time unless we confirm one in writing when you buy.

Early-access and beta versions may contain defects and are provided without any guarantee that they are free of bugs.

When the update period of a license has ended, the installed version keeps working. You can extend the period by 1 or 2 more years with a one-time payment from the License screen of the software; the extension is added to the existing license and the license key does not change.

6. Purchases, prices and taxes

Purchases on marblesend.com are processed by third-party payment providers. Depending on your location, the provider acts as Merchant of Record (for example Paddle or Dodo Payments), in which case it also handles order-related inquiries, invoices, taxes and returns under its own terms; otherwise we are the seller. The provider that processes your payment is named at checkout and on your receipt. Prices and applicable taxes are shown at checkout. Purchases on Envato CodeCanyon are governed by Envato's terms.

7. Refunds

Refunds are covered by our Refund Policy.

8. Acceptable use

You agree not to:

• use MarbleSend to send unlawful, deceptive or unsolicited email;
• attack, overload or reverse-engineer our License Server, or try to obtain licenses you have not paid for;
• share or resell License Keys or Purchase Codes; or
• use MarbleSend in a way that infringes the rights of others.

9. Third-party services

MarbleSend can connect to services you choose, such as SMTP providers and AI providers with your own API key. Those services are governed by their own terms and charges, and we are not responsible for them.

10. Ownership

We and our licensors own MarbleSend and its trademarks. You own your data and email content. We claim no rights over the contacts or content stored in your installation.

11. Disclaimer and liability

To the maximum extent permitted by law, MarbleSend is provided "as is" without warranties of any kind, including fitness for a particular purpose, uninterrupted operation or delivery results.

To the maximum extent permitted by law, our total liability for any claim relating to MarbleSend is limited to the amount you paid for the license in the 12 months before the claim, and we are not liable for indirect or consequential losses such as lost profits, lost data or lost business. Nothing in these Terms excludes liability that cannot be excluded by law, and mandatory consumer rights in your country are not affected.

12. Suspension and termination

We may suspend or revoke a license for material breach of these Terms, license misuse, or payment fraud or chargeback abuse. You may stop using MarbleSend at any time. Sections that by their nature should survive termination, such as ownership and liability, continue to apply.

13. Changes and contact

We may update these Terms; the date at the top shows the latest version, and continued use after a change means you accept it. Questions: hello@marblesend.com.
